Koyera Terms of Service

Acceptance

These Terms of Service (the "Terms") govern your access to and use of the Koyera mobile application and related services (collectively, the "Service") operated by Koyera Team ("Koyera," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Eligibility (17+)

The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.

2) The Service

Koyera helps you compress and optimize photos, reducing file size while maintaining quality. The Service may be offered with features that process photos on your device and/or (if available) on our servers when you choose to upload content for processing.

3) Accounts

If the Service requires an account, you agree to provide accurate information such as your name, username, and email, and to keep it up to date. You are responsible for maintaining the confidentiality of your account and for all activities under your account.

4) Your Content (Photos, Images, and Text You Provide)

You retain ownership of your photos, images, and any text or other content you submit ("User Content").

License to operate the Service: you grant Koyera a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display User Content solely as necessary to provide and improve the Service and to fulfill your requests (for example, compressing an image and returning the output to you).

5) Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or abusive activities.
• Attempt to interfere with or disrupt the Service, systems, or networks.
• Reverse engineer, decompile, or attempt to extract source code, except to the extent permitted by law.
• Upload content that infringes intellectual property rights, violates privacy rights, or is otherwise illegal to possess or distribute.

6) Privacy

Our handling of personal information is described in our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy will control.

7) Intellectual Property

The Service, including its software, design, text, graphics, and trademarks, is owned by Koyera or its licensors and is protected by applicable laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

8) Availability, Changes, and Termination

We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We may also update these Terms from time to time.

You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms or if required for security, legal, or operational reasons.

9) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, Koyera disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Koyera does not guarantee that the Service will be uninterrupted, error-free, or that compressed outputs will meet your specific requirements.

10) Limitation of Liability

To the maximum extent permitted by law, Koyera will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service.

To the maximum extent permitted by law, Koyera's total liability for all claims arising out of or related to the Service will not exceed the amount you paid (if any) to use the Service in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

11) Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Koyera from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms, including your User Content.

12) Governing Law

These Terms are governed by the laws of Koyera's principal place of business, without regard to conflict-of-law principles, except where applicable law requires otherwise.

13) Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations.

The arbitration will be conducted on an individual basis. Class arbitrations and class actions are not permitted. The arbitrator's decision will be final and binding.

14) App Store / Apple Platform Terms

If you obtained the Service through Apple's App Store, you acknowledge and agree that:

• These Terms are between you and Koyera only, not with Apple.
• Apple has no obligation to provide maintenance or support services for the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) in accordance with Apple's policies; to the maximum extent permitted by law, Apple will have no other warranty obligation.
• Apple is a third-party beneficiary of these Terms and has the right to enforce these Terms against you as a third-party beneficiary.
